Please carefully read these Terms of Use for the Website of the Public Organization 'Engineering Corps' (hereinafter referred to as the 'Terms') before using the website of the Public Organization 'Engineering Corps' or making charitable contributions to the organization online through this website (hereinafter referred to as the 'Site'). These Terms contain important information about your rights and obligations. Complete Agreement

These Terms constitute an agreement between us and our users. By using this Site, you agree to comply with these terms and all applicable laws and regulations. You must be of legal age to do so. These Terms and any rules published on the Site, including our Privacy Policy, constitute a complete legally binding agreement between you ('you' or 'user') and the Public Organization, governing your use of the Site and the collection of charitable contributions through the Site. By using the Site, you hereby represent and confirm that: (1) in accordance with the legislation of your country, you are of legal age and have the right to enter into this agreement; (2) the legislation of your country does not restrict you from using the Site; (3) you comply with these Terms and relevant legal requirements.

Activities of the Public Organization 'Engineering Corps'

The Organization's Site is intended for users who wish to make a charitable contribution or otherwise assist the Organization, as well as the Armed Forces of Ukraine, in need of assistance. The 'Engineering Corps' Public Organization is established to assist the Armed Forces of Ukraine through the development of engineering devices that will aid in the country's defense. For this purpose, the Organization collects financial and other assistance, which is exclusively directed towards its statutory activities. The Organization does not belong to any political parties, commercial organizations, or influential individuals, and it is funded through charitable contributions from individuals and legal entities. The Site is intended for users who wish to make a charitable contribution ('Donors') or otherwise assist the Fund ('Volunteers'), as well as representatives of the Armed Forces of Ukraine who wish to receive assistance ('Beneficiaries').

Participation

You can make one-time and monthly payments to the Fund through the Site. The funds received by the Organization are transformed into assistance, including engineering developments and products. Reports on the use of funds can be reviewed on the Site.

Through the Site, users can make charitable contributions to the Organization, which utilizes them for the aforementioned directions. You can make a one-time donation or subscribe to a monthly payment of a certain amount, which can be cancelled by contacting us.

By making a donation to a specific project, you thereby agree that in cases where the fundraising for this project is closed, or it becomes irrelevant, or there is an excess of funds - the funds may be redirected to another project among those that have already been declared, at our discretion. Furthermore, anyone can participate by providing material resources, technical equipment, knowledge, skills, and abilities that can be used for the Organization's statutory activities.

Reports on the use of contributions are prepared quarterly by the Organization, and they are published on the website by the end of the subsequent reporting quarter. Additionally, the Organization annually submits a report on the use of income (profits) to the tax authorities.

Please note that payments through our Site are facilitated by payment service providers that we do not control, namely Liqpay, Wayforpay. Once you click on a link for payment, you must comply with the terms of use, privacy policies, and other policies of such providers. Under no circumstances shall the Organization be liable for payment data processed by these providers.

Receiving Assistance

Representatives of the Armed Forces of Ukraine or volunteers assisting them can submit requests for the development of specific engineering solutions. They can also request the production of devices and the execution of tasks already developed and present in the Organization's database. To reach out to the Organization for assistance, please fill out the form on the website. The Fund does not guarantee the provision of necessary assistance due to critical resource shortages. Please note that we do not engage in providing fighters with mass-produced goods. Third-Party Services and Websites

When using websites and services that we do not control, you must adhere to their terms of use and privacy policies. Certain features of the Site, such as making charitable payments, involve the use of third-party services and websites that the Organization does not control. In the event of any issues, we will make every effort to resolve them. However, we are not responsible for the content and functionality offered on such websites or by such third-party services, as well as for any damages, harm, or other financial liabilities resulting from your use of such third-party websites or services. Please note: Different terms of use and privacy policies apply to your use of third-party websites and services. In no event shall the Organization be liable for personal data processed by third-party websites and services.

Content and Intellectual Property

The Organization owns the Site and all of its content. We grant you certain rights to use the Site and content as provided by these Terms. The Site is owned and controlled by the Organization. All materials on the Site, including texts, images, design, graphics, information, logos, audio and video recordings, interfaces, software, trademarks, trade names, and others ("Content"), as well as copyrights and other intellectual property rights to such Content, are owned by the Organization or posted with the owner's consent. The Content or any elements thereof must not be used without the prior written permission of the Organization or the respective owners, in any manner not provided for by these Terms. Subject to your compliance with the provisions of these Terms, the Organization grants you a limited, non-exclusive, revocable license, without the right to sublicense and transfer, to: (i) use the Site from your personal devices under the conditions specified in this document; and (ii) access and view any Content posted on the Site or through the Site, solely for personal non-commercial use. By downloading or creating copies of the Content, you do not acquire any rights to such Content. The Organization is responsible for the use of charitable contributions in accordance with the applicable laws of Ukraine. However, we make no promises or warranties, including accuracy, usefulness, reliability, and correctness of the Site's operation. The Organization does not guarantee that the Site will be uninterrupted or secure, that any defects will be corrected, or that the Site is free from viruses or other harmful elements. The Organization is not liable if any information, materials, content available on the Site are inaccurate or incomplete, as well as for typographical errors or defects in the text or other materials. Under no circumstances shall the Organization, its founders, employees, contractors, or volunteers be liable for direct, indirect, incidental, special, punitive, or consequential damages related to your use or inability to use the Site, including, among others, any damages resulting from errors, omissions, or interruptions, defects, viruses, even if the Organization has been advised of the possibility of such damages. The above provisions regarding the disclaimer of warranties and limitation of liability apply to the extent permitted by applicable law.

Indemnification

You are responsible for your use of the Site. If you cause harm to someone else or get into a dispute, we won't be involved in resolving it. To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the Organization, our partners, employees, contractors, and volunteers from any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising from or in any way related to: (i) your violation of any of these Terms, (ii) your use/misuse of the Site, content, functions available on the Site, or (iii) your violation of laws or third-party rights. You also agree to indemnify the Organization for any damages and expenses incurred by it (including fees or expenses of lawyers, accountants, professional advisors, and other experts) in connection with the defense or settlement of disputes arising from your use of the Site for any unlawful or prohibited purposes. We reserve the right to choose the methods of legal defense that we deem necessary, including cases in which you release us from liability. Therefore, you agree to cooperate with us in implementing our strategy for protecting our rights.

Applicable Law and Dispute Resolution

This agreement is governed by the laws of Ukraine. We hope to resolve all matters amicably, but in the event of a serious dispute between us, it must be resolved in a Ukrainian court. Except as otherwise expressly provided by these Terms or other policies on the Site, these Terms are written and interpreted in accordance with the laws of Ukraine. If any material on the Site or your use of the Site violates the laws of your jurisdiction, the Site is not intended for you, and we ask you not to use it. You are responsible for familiarizing yourself with the laws of your jurisdiction and complying with them. Any dispute, conflict, claim, or controversy directly or indirectly related to the Site or these Terms, including their validity, interpretation, or application, must be resolved through peaceful negotiations directly with the team of the Public Organization "Inzhenerny Korpus" in accordance with the principles of good faith and cooperation. If consensus is not reached through negotiations, the dispute must be resolved exclusively in the courts of Ukraine, following the rules of jurisdiction in accordance with the current substantive law of Ukraine. All claims must be brought within one (1) year from the date of their occurrence, except where applicable law requires a longer period.

Electronic Communications

By providing us with your email through the Site, you understand and agree that we may send you messages to the contact information you provided, especially those related to cooperation. You have the option to opt out of receiving electronic communications from us by sending an appropriate email to our email address.

Other Terms

If any of the provisions of these Terms is deemed unlawful, void, or unenforceable, the other provisions of these Terms shall remain in effect and enforceable. We may assign our rights and obligations under these Terms to a third party, but this will not affect your rights or our obligations under this agreement. The printed version of these Terms is admissible as evidence in a judicial or administrative proceeding arising from or related to the use of the Site, to the same extent and on the same terms as other business documents and records that were created and stored in printed form. We reserve the right to make changes to these Terms at any time.
